The article presents the principle of audi alteram partem - i.e. the concept of the principle of the right to be heard. The content of this concept is revealed, international and national legal acts related to the establishment of the right to be heard in civil, criminal and administrative proceedings are analyzed in the article. Following the announcement by the World Health Organization of a pandemic for the spread of the Covid-19 virus, countries facing this dangerous disease had to make decisions that affect the management of the spread of the virus. As a result, many states have decided to declare a state of emergency, extreme situation or quarantine, and certain restrictions on individual rights have been introduced. The organization of the courts and pre-trial dispute resolution bodies, so called quasi-courts has also changed, and in many countries, due to the unfavorable epidemic situation in Covid-19, decisions have been taken to adjourn oral proceedings or written proceedings. These decisions have been enshrined in different levels of legislation and are the subject of debate as to their legality and proportionality.
The article analyzes the system of legal regulation of the higher education in Lithuania with the purpose to determine the boundaries of exercising the discretionary powers of the executive institutions in the field of higher education. The article is made of two parts. Discretionary powers of the executive institutions in legislative field are discussed in the first part. The power of legislative discretion is described as a right to set the legal regulation by way of a subject who is granted such discretionary power. Problems may arise in cases when the law granting such discretionary powers is too abstract or declarative. The main criteria in determining the boundaries of exercise of discretionary powers are the provisions of Constitution and laws, and constitutional law principles. The system of delegation of legislative powers in the field of regulation of the higher education in Lithuania is analyzed in the second part of the article. The permanent changes in administrative legal regulation of higher education and studies determined by a vast amount of subjects issuing post-legislative legal acts in this field, as well as rather tediouslegal regulation which, in turn, calls for frequent changes in legal acts, raises doubts regarding a possibility to implement main principles of the studies, such as freedom of creation and scientific research or academic freedom and autonomy. ; Straipsnyje analizuojama Lietuvos aukštojo mokslo teisinio reguliavimo sistema, siekiant nustatyti įstatyme numatytas vykdomosios valdžios institucijų legislatyvinės diskrecijos teisės aukštojo mokslo srityje įgyvendinimo ribas. Straipsnį sudaro dvi dalys. Pirmojoje aptariamos vykdomosios valdžios institucijų diskrecinės galios teisėkūros srityje. Legislatyvinės diskrecijos teisė suprantama kaip teisė nustatyti teisinį reguliavimą subjekto, kuriam suteikta diskrecijos teisė, nuožiūra. Pastebima, kad legislatyvinės diskrecijos teisę aukštojo mokslo srityje turi ne tik Parlamentas, bet ir Vyriausybė, Švietimo ir mokslo ministerija, kitos ministerijos, Lietuvos mokslo taryba, Valstybinis studijų fondas, Studijų kokybės vertinimo centras, akademinės etikos ir procedūrų kontrolierius, taip pat kitos Vyriausybės bei Švietimo ir mokslo ministro įgaliotos institucijos. Įstatymų leidėjas neapibrėžia baigtinio teisėkūros funkciją šioje srityje vykdančių subjektų sąrašo. Taip pat įstatymų leidėjas nenumato baigtinio teisės aktų, kurių pagrindu vykdomosios institucijos įgyja diskrecijos teisę aukštojo mokslo teisinio reguliavimo srityje, sąrašo. Vykdomosioms institucijoms nėra suteikiama diskrecijos teisė nustatyti aukštojo mokslo misiją bei mokslo ir studijų principus. Valstybės mokslo ir studijų politiką, kurią pagal teisės aktuose nustatytą kompetenciją turi įgyvendinti viešojo administravimo institucijos, formuoja Seimas. [.]
For the last several decades, ensuring human rights and national security have remained an important goal and a condition for existence of every state. The interests of national security often presuppose the need to narrow some natural rights, such as, for example, the right to privacy, the right to secrecy of communication, etc. Traditional concept of security is related to ensuring national security. According to the traditional concept of security, the state is considered the main object of security; therefore, the states mainly focus on external threats. It is stated that the most important thing is to protect the state from external aggression, ensure protection of state borders and institutions. Protection of human rights is ensured simultaneously. It is, however, observed that a secure state does not necessarily mean that the citizens of the state are secure. Security of a person is under threat due to limitations imposed on human rights while seeking to ensure national security. An issue related to protection of human rights is presented in the article, when limitations on a person's right to privacy are foreseen for the purposes of protection of national security. ; Pastaraisiais dešimtmečiais žmogaus teisių įgyvendinimo ir apsaugos klausimas yra tapęs demokratinių valstybių prioritetu. Žmogaus teisės įtvirtintos tiek nacionaliniu, tiek tarptautiniu lygmeniu, jų apsaugai sukurtos institucinės sistemos. Kita vertus, nacionalinio saugumo užtikrinimas, kaip ir žmogaus teisių apsauga, yra labai svarbus kiekvienos valstybės uždavinys ir egzistavimo sąlyga. Neretai nacionalinio saugumo interesai suponuoja poreikį susiaurinti kai kurias prigimtines žmogaus teises, pavyzdžiui, teisę į privataus gyvenimo neliečiamumą, teisę į asmens susirašinėjimo slaptumą ir kitas. Tradicinė saugumo koncepcija yra siejama su nacionalinio saugumo užtikrinimu. Pagal tradicinę saugumo sampratą, saugumo objektu laikoma valstybė, todėl pagrindinis valstybių dėmesys sutelkiamas į išorės grėsmes. Teigiama, jog svarbiausia yra apsaugoti valstybę nuo išorės agresijos, užtikrinti valstybės sienų bei institucijų apsaugą. Kartu užtikrinama ir žmogaus teisių apsauga. Tačiau pažymima, kad saugi valstybė nebūtinai reiškia ir saugius jos piliečius. Todėl žmogaus teisių apsaugos klausimas, siekiant užtikrinti nacionalinį saugumą, yra labai aktualus klausimas. Straipsnyje pristatoma problema, susijusi su žmogaus teisių apsauga, kai nacionalinio saugumo užtikrinimo tikslais valstybėse numatomas žmogaus teisės į privatumą apribojimas. Straipsnį sudaro dvi dalys. Pirmoje aptariama teisės į privatumą esmė, reikšmingumas ir santykis su kitomis žmogaus teisėmis. Pristatomi nacionaliniai ir tarptautiniai teisės aktai, skirti žmogaus teisių, tarp jų ir teisės į privatumą, apsaugai. Atkreipiamas dėmesys, jog iki šiol nėra pateiktos išsamios visa apimančios privatumo sąvokos. Taip pat nurodoma, jog keičiantis gyvenimo sąlygoms, vystantis technologijoms, atsiranda vis naujų grėsmių privatumui. Pristatomas mokslininkų požiūris į tris privatumo aspektus: fizinį, informacijos ir nuosavybės. Pažymima, kad teisė į privatumą nėra absoliuti ir gali būti teisėtai ribojama, siekiant tam tikrų, reikšmingų visuomenei tikslų. Antroje straipsnio dalyje pristatoma teisės į privatumą ribojimo poreikis ir nacionalinio saugumo užtikrinimo būtinybė. Pagal tradicinę saugumo sampratą, saugumo objektu yra laikoma valstybė, todėl svarbiausia yra apsaugoti valstybės sienas, institucijas, vertybes, žmones. Pastaraisiais dešimtmečiais vyraujant nuomonei, kad nacionaliniam ir netgi tarptautiniam saugumui didžiausią pavojų kelia terorizmo grėsmė, valstybės ėmėsi legalizuoti prigimtinių žmogaus teisių apribojimą. Pristatoma teisės aktų analizė liudija, jog Lietuva numatė įvairių priemonių kovoti su terorizmu, ypač numatydama kliūtis terorizmo finansavimui. Teisės aktai numato pareigą daugeliui valstybinių, taip pat ir nevalstybinių institucijų (pvz., advokatai, notarai, auditoriai) pareigą rinkti informaciją apie asmenis, siekiant užkirsti kelią galimam pinigų plovimui, o tuo pat metu jie turi teisę tam tikra prasme įsiveržti į tų asmenų privataus gyvenimo erdvę. Pažymima, jog iki šiol Lietuvoje nebuvo atlikti tyrimai, kiek tikslinga suvaržyti asmens privataus gyvenimo neliečiamumą numatant pareigą įvairiems subjektams rinkti informaciją apie asmenų sudaromus sandorius, giminystės ryšius, keičiamą valiutą, turimus indėlius ir kita. Iki šiol taip pat nebuvo atlikti ir tyrimai, kiek Lietuvos gyventojai gali dalyvauti teroristinėje veikloje, kiek realus teroristų finansavimo iš Lietuvos pavojus. Be to, taip pat nėra tyrinėta, kiek Lietuvos žmonės jaučiasi nesaugūs dėl tos aplinkybės, kad daugybė subjektų renka, saugoja ir perduoda kitiems informaciją apie jų privatų gyvenimą. The article presents the development of the Lithuanian administrative justice system. Administrative justice is understood as a specialized system for resolving disputes arising in the field of public administration. The origins of Lithuanian administrative justice are linked to the works of legal scholars before the Second World War. During that period, professors M. Romeris and P. Leonas focused on the issue of administrative justice and control of the legality of administrative actions in their researches. Lithuanian scholars already justified the need for administrative justice before the war, modeled a possible system of administrative justice, but their theoretical insights and draft laws on the establishment of an administrative court were not implemented until the restoration of Lithuania's independence. Only in 1999 specialized administrative courts were established in Lithuania. Also during that period, special pre-trial administrative dispute resolution institutions were established: the Supreme Commission for Administrative Disputes and Tax Disputes Commission. The structural reform of Lithuanian administrative courts and the Supreme Commission for Administrative Disputes took place in 2018. The system of administrative justice is still being reformed and new bills have been submitted to Parliament. Therefore, the article discusses the changes that have already taken place and the changes in administrative justice in Lithuania planned for the near future.

Firstly, the security theories of different authors are analysed, which usually focus on military, political, economic, social and environmental threats. Furthermore, the nature of threats to energy sector which is becoming more and more important for any state's proper functioning is explored. Lastly, the main international documents containing both political declarations and legal obligations are analysed, that is, the European Energy Charter, Energy Charter Treaty and International Energy Charter are analysed. The important facets of energy security are diversification of energy sources, security of transit, liberalisation of energy markets, which in turn help ensure continuous and uninterrupted flow of affordable energy.
The article discusses the problem of prevention of radicalisation in religious schools in Europe. In this publication the authors of the publication aim to present a systematic analysis of the legal framework of religious education and its relationship and limitations in the aim to prevent radicalization. In order to achieve the aim of the research the following tasks will be carried out: revealing of the essence of the freedom of right of thought, religion and conscience and their relation to religious education; analysing documents, strategies and policies addressing the prevention of radicalization in Europe; evaluating the intersection of right to religious education and the need to prevent radicalisation. The question is relevant due to the ever-increasing number of terrorist acts performed by persons who have been born in European states (so called home-grown terrorists). The publication discusses the right to religion and the right to religious education and its limitations. The development of EU policy in the field of counter-terrorism and counter-radicalisation is extensively discussed. Finally, the guidelines are drawn for the conciliation of the freedom to religion and beliefs and the pressing need to prevent persons from radicalisation.

The educational system of Lithuania has undergone transformation conditioned by the radical change of the political situation in the region after the restoration of independence on March 11, 1990. The new educational system was gradually developed, changing and denying the former Soviet educational framework. The main goal of the new educational system is to provide education compatible with the newly applicable international standards and create an effective network of schools. The article aims to present an overview of the reform of the institutional system of general education of Lithuania that began in 1988 and was to be completed in September 2015; however, the completion of the reform was recently postponed until September 2017. The article also reviews key challenges to the reform implementation and discusses the compatibility of the reform with societal expectations and standards of international educational law.

Antroje straipsnio dalyje pristatoma institucinė Lietuvos nacionalinio saugumo sistema, kuri buvo sukurta po Nepriklausomybės atkūrimo. Šiuo metu pagrindinės vadovaujančios nacionalinio saugumo užtikrinimo institucijos yra Lietuvos Respublikos Prezidentas, Vyriausybė ir Seimas. Kitos vykdančiosios institucijos yra šios: Valstybės gynimo taryba, Krašto apsaugos ministerija, Ginkluotųjų pajėgų vadas ir Gynybos štabas, kariuomenė, policija, Valstybės saugumo departamentas, Specialiųjų tyrimų tarnyba. Lietuva prisijungė prie tarptautinių organizacijų, kurių tikslas užtikrinti ekonominį, aplinkosauginį saugumą, bendrai formuoti tarptautinio saugumo užtikrinimo sistemą. Pagrindinės grėsmės Lietuvos nacionaliniam saugumui yra pristatytos trečiojoje straipsnio dalyje. Yra įvairių grėsmių Lietuvos nacionaliniam saugumui, pavyzdžiui, karinių, politinių, ekonominių, socialinių ir aplinkosaugos. Pačios pavojingiausios grėsmės yra susijusios su: nusikalstamomis veikomis, kaip antai terorizmas, organizuotas nusikalstamumas, prekyba žmonėmis, kontrabanda, nelegali prekyba ginklais, narkotikais, nelegali migracija, kuri peržengia nacionalinių sienų. Ekonominė krizė, kuri įtakoja augančią emigraciją ir socialinį nestabilumą Lietuvoje, energetinė priklausomybė taip pat kelia grėsmę Lietuvos nacionaliniam saugumui. ; Second part of the article presents institutional national security system in Lithuania, which was established after the restoration of Independence of the State. At the moment the leading institutions which guide the ensuring of national security in Lithuanian Republic are the President of the Republic of Lithuania, the Government and the Seimas. Executive and other institutions are the State Defence Council, the Ministry of National Defence, and the Commander of the armed forces and the Defence Staff, the armed forces, the police, the State Security Department, the Civil Resistance Training Centre, the Department of Civil Defence, the Weaponry Directorate. Lithuania was integrated into the International defence, economic, environmental and similar international organizations that aim to ensure security on national and global basis. Main threats to Lithuanian national security are identified in the third part of the article. There are different kinds of threats to Lithuanian national security, such as military, political, economic, social and environmental. The most dangerous threats are related to: criminal activities, such as terrorism, organized crime, human trafficking, smuggling, illegal arms trafficking, drug trafficking, illegal migration, which transcends national borders; economical crisis, which influences increasing emigration and social instability in Lithuania; dependency on supply of raw strategic materials and energy from other states.
Every religious and philosophical theory of ethics tends to determine what is good, and what is evil. Among ancient peoples religious laws governed every aspect of the communitys life. Ancient legal and moral codes have a religious quality because religion and government were never separate in the ancient world. In the teaching of the utilitarian, the utility is regarded as the basis of the appropriateness and of the obligation. Thus proceed the formation of the public utility concept. The purpose of this study – to examine the impact of the ancient Near East Law, Philosophy and Religion on human rights. Human rights in the early civilizations of both the East and the West were composites of various philosophies that served a peoples social and cultural contexts. The Code of Hammurabi from about 1800 B.C. is often cited by historians for its foundational place in the Western tradition of human rights. In the Hebrew Bible ethics also can be referred to as "human rights," but they are based on a very different foundation than the "human rights" commonly promoted today. Both the Hammurabi Code and the Hebrew Bible are utilitarian in their approach, but in the biblical writings use of both utilitarian and deontological methods are used. In a narrow sense, the Mosaic Code reflects the point of view of the radical relativism school. In a broad sense, some of the Commandments involve protecting people from other people, and in this sense a form of "human rights" is established At the very heart of biblical ethics lie the fundamental values that infuse moral conduct and principles. In the Hebrew Bible all morality was legislated. No distinction was made between law and morality, as one could find in a pluralistic society. ; Kiekviena religinė ir filosofinė etikos teorija stengiasi nustatyti kas yra gera, o kas yra blogis. Visuotinai pripažįstama, kad gėriui būdinga tai, kad jo trokštama. Senovės tautų religiniai įstatymai reglamentuoja kiekvieną bendruomenės gyvenimo aspektą. Antikiniai teisės ir moralės kodeksai visada turėjo glaudų sąryšį su religija, nes nebuvo griežtos takoskyros tarp religijos ir politikos. Judaizme, Islame, ir daugelyje senovės politeistinių religijų centrinę vietą užėmė Dievo įsakymas. Bet tampa neaišku – Dievo įsakymas teisingu ir naudingu padaro veiksmą ar jo rezultatą? Utilitarizmo mokyme naudingumas laikomas deramumo ir pareigos pagrindu. Tam tikras poelgis teisingas tada, kai jo naudingumas yra ne mažesnis, negu kurio nors kito alternatyvaus poelgio. Poelgis neteisingas, kai jo naudingumas mažesnis. Naudingumas suprantamas kaip indėlis į gerais laikomų dalykų ir situacijų sąrangą. Anot J.S. Mill, žmogus – sociali būtybė, todėl jo siekius kontroliuoja visuomenė. Šitaip visuomenėje formuojasi naudingumo samprata. Naudingumas yra determinuotas visuomenės pritarimo arba nepritarimo, vadinasi, naudingumas yra socialiai determinuotas. Antikinėse Rytų ir Vakarų civilizacijose ţmogaus teisių sistemą svarstė vairios filosofinės srovės. Iš Istorikų teigimu, Hamurabio kodeksas apie (1800 m. pr m. e.) padėjo pagrindus dabartinei vakarietiškai žmogaus teisių sistemai. Nors kodekse pastebimas didelis skirtumas bajoro ir vergo atžvilgiu, tačiau šiuo teisynu buvo bandyta atsikratyti primityvaus visuomeninio tribalizmo, likusio iš primityvios visuomeninės santvarkos. Žmogaus gyvybės svarbą pripažinimo ir skelbė hebrajų Biblijos tikėjimo sistema. Tai – pirmoji ir būtina žmogaus teisių sistemos funkcionavimo sąlyga. Hebrajai tikėjo, kad žmogus sukurtas pagal Dievo paveikslą ir panašumą. Taigi, kiekvienas asmuo labai vertingas ir svarbus. Hamurabio kodeksas pasižymėjo utilitarizmo tendencija, ir tapo beveik visų šiuolaikinių teisės kodeksų pagrindu. Mozės teisynas buvo dvišalė sandora, kuri buvo skirta specialiai Izraeliui tam, kad hebrajai vieninteliai turėtų teisę į pažadėtąją žemę. Hebrajų Biblijoje nėra takoskyros tarp teisės ir moralės. Biblijos raštuose, priklausomai nuo raštų grupės ir rūšies, naudojami deontologinis ir utilitarinis metodai. Siaurąja prasme, Biblijos raštai ir Mozės teisynas atitinka radikalaus reliatyvizmo mokyklos tendencijas. Plačiąja prasme, Dešimt Dievo įsakymų, gali būti traktuojami kaip potencialus civilinės valdžios moralės pagrindas. Šių įsakymas pagrindinis tikslas – apsaugoti žmones nuo kitų žmonių, ir tokiu būdu tam tikra prasme nustato "žmogaus teisių" standartą. Specifinė Dešimties Įsakymų forma tikslas leidžia daryti ir kitą išvadą: Įstatymai yra tik kryptis, siektinas tikslas. Jie turi būti tokie aiškūs, kad niekam nekiltų abejonių dėl laikymosi. Jei šie įstatymai ignoruojami arba pažeidinėjami, gyvenimas bendruomenės tampa neįmanomas arba nepakeliamas. Hebrajų Biblijoje moralė buvo neatsiejama nuo teisės. Joje neliko skirtumo tarp teisės ir moralės, kaip tai pastebima dabartinėje pliuralistinėje visuomenėje. Biblijos etikos dėmesio centre – fundamentalios vertybės, kad dieviško autoriteto nustatyti moralės normos ir principai.
The numbers of internet users are growing rapidly. A recent innovation is the creation of virtual worlds which promise an entire social life in cyberspace. During last decades information technology is considered as a major threat to privacy, because it makes prerequisite of pervasive surveillance, large databases, and lightning-speed distribution of information across the world. There are continual limitings of privacy and personal data abuse, made by Internet services providers. After the attacks of terrorist of September 11, 2001 in New York, communities around the world revalued existing rules and methods of dealing with information. The limiting of privacy is settled by law enforcement and by governments. The main question arise: does the privacy in its classical meaning match to the actual state of things? ; Teisė į privatumą asmenims, socialinėms grupėms arba institucijoms suteikia teisę reikalauti, kad būtų nustatyta kada, kaip ir kokia apimtimi informacija apie juos gali būti atskleidžiama kitiems. Privataus gyvenimo laisvė - tai visuotinai naudingas pripažinimas, kad yra egzistencinė erdvė, kuri priklauso tik individui ir kiti neturi teisės į ją brautis. Šiais laikais internete žmogaus teisė į privatumą internete yra labai ribojama. Grėsmė interneto vartotojų privatumui nuolat didėja. Vystantis informacinėms technologijoms, galimybė rinkti duomenis, juos saugoti, suderinti tarpusavyje ir panaudoti šią informaciją tapo labai nesudėtinga operacija. Saityne egzistuoja milžiniškos duomenų bazės, kuriose saugoma milžiniški kiekiai įrašų su informacija apie internautų finansus ir kreditus, jų medicininiai įrašai, duomenys apie pirkimus ir telefoninius skambučius ir t.t. Dauguma žmonių net nežino, kokią informaciją apie juos turi ir saugo Interneto paslaugų teikėjai, nežino kas turi prieigą prie jų duomenų. Dabartinė teisinė bazė, reglamentuojanti elektroninę erdvę ir veiklą joje, nepakankamai veiksminga, todėl nėra teisinių priemonių, galinčių pažaboti interneto paslaugų teikėjų piktnaudžiavimą interneto vartotojų asmens duomenimis. The article presents the consideration about the right to privacy of the individual vs. public interest in the context of the challenges of globalization of personal data ecosystem, new trends of information technologies and the digital economy boost. A new computing and information sharing architecture and technologies has emerged during the past 10 years. The proposed European Commission Data Protection Regulation currently under discussion by the European Council and Parliament is the most comprehensive attempt to establish new norms for the flow of personal data. While different views were expressed throughout the dialogue on these proposals and the underlying principles, it was clear that these rules when agreed would be the big step forward creating and implementing the new Personal Data ecosystem. While the complexity of operating in a decentralized and distributed networked environment poses new challenges, ensuring Personal Data security remains crucial. ; Skaitmeninės revoliucijos, spartaus internetinių technologijų plėtros, milžiniškais tempais didėjančios informacijos ir duomenų apimties, virtualių socialinių tinklų ekspansijos kontekste asmens duomenų apsaugai kyla vis nauji iššūkiai. Atlikus teisės aktų ir informacinių technologijų plėtros tendencijų analizę, straipsnyje konstatuojama, kad globalizacija ir naujos asmens duomenų ekosistemos koncepcija verčia persvarstyti tradicines asmens duomenų ir jų apsaugos sampratas bei jų santykį su viešuoju interesu, kurį atstovauja skaitmeninės ekonomikos, mokslo ir technologijų plėtra. 2012 m. Europos Komisija pasiūlė iš esmės reformuoti Europos Sąjungos asmens duomenų apsaugos teisės aktus. Siūloma reforma turėtų sustiprinti individualias teises, spręsti globalizacijos keliamas problemas bei naujas technologijų plėtros iššūkius. Straipsnyje atskleidžiama, kad aktuali Lietuvos Respublikos Asmens duomenų teisinės apsaugos įstatymo redakcija, griežčiau už Europos Sąjungos teisines normas reguliuojanti asmens duomenų naudojimą ir jų apsaugą, apsunkina pažangių kalbos ir semantinių technologijų plėtrą Lietuvoje, nors šioje srityje Lietuva 6-8 metais atsilieka nuo Europos Sąjungos vidurkio. Autoriai prieina išvados, kad susidariusioje situacijoje, nelaukiant Europos Sąjungos asmens duomenų apsaugos reformos rezultatų, Lietuvoje būtina tarpinė asmens duomenų apsaugą reguliuojančių teisės aktų reforma, nes susidariusi teisinė ir technologinė situacija kelia rimtą grėsmę asmens teisei į privatumą, asmens duomenų apsaugai bei viešajam interesui.
The educational system of Lithuania has undergone transformation conditioned by the radical change of the political situation in the region after the restoration of independence on March 11, 1990. The new educational system was gradually developed, changing and denying the former Soviet educational framework. The main goal of the new educational system is to provide education compatible with the newly applicable international standards and create an effective network of schools. The article aims to present an overview of the reform of the institutional system of general education of Lithuania that began in 1988 and was to be completed in September 2015; however, the completion of the reform was recently postponed until September 2017. The article also reviews key challenges to the reform implementation and discusses the compatibility of the reform with societal expectations and standards of international educational law.
